Opis

Želite li se pobliže upoznati s problematikom otvaranja tržišta zemaljskih usluga u Europskoj uniji i Republici Hrvatskoj? Koje zahtjeve pred zračne luke postavlja europski zakonodavac te koji su najčešći izazovi ulaska novih pružatelja zemaljskih usluga na novo tržište? Kako hrvatski propisi uređuju navedena pitanja i koji su daljnji koraci za hrvatske zračne luke?

O svemu tome saznajte više na radionici pod nazivom “Izazovi otvaranja tržišta zemaljskih usluga na zračnim lukama u Europskoj uniji i Republici Hrvatskoj” u organizaciji Hrvatskog društva za transportno pravo (HDTP) u suradnji s Hrvatskom udrugom poslodavaca (HUP) koja će se održati u petak, 6. rujna 2019., u prostorijama HUP-a, Radnička cesta 52/I kat, Zagreb.

Highlights:
• Why: Market liberalisation and creation of a single European aviation market
• What: The concept of ‘workable competition’ guiding the work of European Commission / National Competition Authorities, economic efficiency, consumer welfare and fair competition

11.30-12.30: Prof. Jasminka Pecotić Kaufman: ‘Applying competition rules in the liberalized aviation market: what constitutes an abuse of a dominant position by an infrastructure operator and how to avoid it’
Highlights:
• defining relevant markets and establishing dominance, in particular in the context of an infrastructure
• the notion of abuse of a dominant position, and its various form
• the essential facility doctrine and access to infrastructure
• theory of harm in abuse cases, in particular, market foreclosure

14.00 – 15.00: Ana Kapetanović, J.D.: “Liberalization of groundhandling market: Croatian case”
Highlights:
Directive 96/67/EC on access to the groundhandling market at Community airports has raised many questions in practice and resulted in different ways of transposition in each EU member state. Significant rise in air passenger traffic in Croatia has led to application of the Directive to three Croatian airports, thus bringing new challenges with regards to the interpretation of applicable EU and national law. For example, certain requirements for airport operator arising from the national legal framework could be more difficult once the new entrant to the groundhandling market is approved, while certain provisions of Directive 96/67/EC can be challenging for airports with extremely seasonal business activities.
